Building Defect Inspection Reports

Eagle Eye Building Consulting can provide the property owner or Strata Manager with a report based on building defects which have occurred within the 6 year period after the completion of the building works or more recently when there is alleged incomplete work and or defect during the construction process or around the time of practical completion.
The advantage of a Building Defects Inspection Report is to have an independent Building Expert Report which can then be issued to the builder for the rectification of the defects or incomplete works.
A Building Defects Inspection Report can be just a list of the issues or contain photographs, cost estimates and method of rectification. This all depends on the current situation.
A Building Defects Inspection Report can also be done for litigation (court or NCAT), however a lot more evidence and a different format is required for such reports.
Some defects within properties recently constructed or renovated or extended may be claimable against the builder under Home Warranty Insurance if the defect falls within the 6-year period from the completion date. In determining what is a claimable defect, a site inspection is required to determine the areas of non-compliance with the National Construction Code (NCC), Building Code of Australia (BCA) or Australian Standards (AS).

Design Services

Eagle Eye Building Consulting can assist you all the approvals you need for your building project. We can prepare the concept designs, drawings for Council Approval, and then coordinate consultants for other required documents or drawings. Our consultants will:

  • Explain our Plans & Approvals service
  • Meet you on site to discuss your brief carry out a site measure and prepare measured drawings.

Progress Stage Inspections

Your Eagle Eye Consultant can check the quality of the work at various stages and can authorise progress claims, your Eagle Eye Consultant can help troubleshoot unexpected issues and give you tips on how to handle difficult or temperamental builders and tradesmen.
Your Eagle Eye Consultant will check the documents are right, so you know that the builder or tradesman is complying with all the regulations and that the quality of the work is acceptable.

Even the best builders make mistakes. Their subcontractors may take short cuts. Supervision may be may miss something and the contractor rarely looks in all the hard to get places, such as roof interior, sub=floor and those flashing's behind the chimney. Councils and private certifiers do not always take responsibility for quality building work. Sometimes the builder does not even notify them to inspect the work. Building a house is a big investment and you need to ensure that the construction is being done correctly and to plan. Eagle Eye Building Consulting can inspect your property whilst its being built. We offer 5 stages of inspection:

  • Steel reinforcement prior to slab being poured

Building Handover Report

A Final Report is an inexpensive way of ensuring new building work is up to scratch. The Report will identify:

  • items which are unfinished (incomplete work), which often includes numerous minor issues;
  • problems which need fixing (defective work); and
  • certification that we recommend you ask the building contractor to give you.

This Certification is proof that major parts of the work have been properly inspected by people qualified to do so - for instance a termite protection, waterproofing, lift or air-conditioning systems.

A Final Report should be prepared and reviewed before making final payment to the building contractor. Once the building contractor claims the work is practically complete; most building contracts include a period for an Inspection to be conducted and a Final Report prepared. After which the contract usually allows for a period where the building contractor repairs and completes what is required. In our experience most builders favour a Final Report by independent party being prepared so they can address problems before you take possession. We provide a list of things the contractors should fix prior to you making final payment. Lease Check Report

Lease Check Reports identify broken, damaged or non-complying parts of a property immediately prior to the commencement of a lease. A Lease Check Report includes a photographic record to minimise the risk of disputes about the condition of the inspected property's and the contents of the Report. When you lease property, you take on strict responsibilities to maintain the area you lease and contribute to any shared repair costs of certain amenities and external maintenance.

Before signing the lease, it is important to know the condition of everything you are leasing, or you may end up paying to have something that is broken or damaged fixed at the end of the lease. For example, cracked basins, damaged doors, defective hardware or water damaged cabinets can be costly to fix. A Lease Check Report highlighting what should be excluded may save you many thousands of dollars in rectification costs. In some cases, we will advise that you ask the Landlord to replace or install damaged or missing items, such as fire safety measures, so the defects or damage don't become sore points over the duration of the lease. Strata Building Bond and Inspection Scheme Reports

New residential houses, townhouses, villas and home units under three storeys require insurance under the Home Building Compensation Fund (HBCF, formerly known as Warranty Insurance). There is currently no requirement for HBCF insurance for residential high-rise strata buildings (those over three storey's in height). Under the new laws, developers will be required to lodge a bond with NSW Fair Trading in the form of a financial security equal to 2% of the contract price for residential and mixed-use high-rise strata buildings. An occupation certificate will not be issued until the bond has been lodged with NSW Fair Trading. The bond will provide the funds necessary to fix defective work that has not been rectified within the necessary time frames.
The new requirements will only apply to building work commenced, or contracts entered into, after the commencement of the reforms. The bond is not payable until it is time to get an occupation certificate.

Scott Schedule and Cost Estimating

A Scott Schedule is an additional document required by the NCAT or Court which outlines the Applicants and Respondents evidence with cost estimates of each item claimed regarding building defects, incomplete works or variations to the building contract.

Sydney Building Reports has many years of experience in compiling Scott Schedules for litigation matters, however, an Expert Report is also required prior to submitting a Scott Schedule. Dilapidation Reports

Dilapidation Reports are carried out to record the condition of a property located adjacent to proposed building or infrastructure works. The report is comprised of observations, photographs, and sometimes diagrams all of which create a snapshot of the condition of buildings and/or infrastructure at a point in time.

Dilapidation inspections are usually conducted immediately prior to the commencement of proposed building work and always before major excavation or construction work involving heavy machinery. Many Authorities require Dilapidation Reports to be carried out on properties adjoining, near, over or under proposed building or infrastructure works, or as part of the DA conditions of approval.
The purpose of Dilapidation Reports is to avoid costly litigation at the completion of building works by establishing a record of the condition of a buildings and/or infrastructure prior to constructions.

Expert Witness Reports

An Expert Report is advice to a consumer, contractor or consultant prior to legal action taking place. Quite often we may have already prepared a Technical Report which should have identified the main issues. However, an Expert Report is in a specific form such as a Scott Schedule with photographic or other evidence annexed. It contains the Expert's agreement to comply with the Expert Witness Code of Conduct in the relevant jurisdiction.

Construction Final Inspection

The cost of this report depends on whether we have carried out the initial inspections or not. Maintenance Reports

If your building is less than 2 years old (for non-structural minor defects) or 6 years old (for major defects), we can inspect it and provide you with a consolidated list of all the defects and incomplete work that contractors often leave you to live with. We will examine the existing condition of the building, and carefully and clearly report the main issues for you and estimate the likely repair and replacement costs. This estimate is based upon the remaining life of all key materials and allows you to more accurately plan for future expenditure without the bad news of unexpected special levies.

If the building is less than 6 years old, we can inspect it and provide you with a consolidated list of all the defects and incomplete work that contractors so often leave you to live with. You can use this list to get the contractor to rectify and complete any defects. If the builder doesn't cooperate, we can help you lodge a complaint or insurance claim against the contractor.

When building work is necessary, we can also help you find the right contractor and plan the sequence of work to minimise inconvenience to occupants. We prepare a scope of works including any troublesome details, analyse quotes, carry out progress inspections and authorise payment when each stage is complete. Once the extent of work is known and completed, you can obtain a more accurate Sinking Fund Assessment. Contract Administration

Eagle Eye Building Consulting we offer Contract Management and Contract Administration services in the Sydney area. Following on from the Management of Tendering Process & Tender Assessment stage, once the contractors have been chosen, the contract between the parties has been agreed and signed, and the works have commenced, we can provide further assistance in Contract Administration by carrying out the following activities:

  • Agreeing the percentage of works completed;
  • Processing the contractor’s progress claims with recommendations for payment/non-payment;
  • Control and agree release of retention sums;
  • Accurate assessment of the contractor’s progress claims, including if applicable, assessment of variation claims and providing recommendations for payment including determining the final costs for prime cost or provisional sum items and similarly, contingency sums allowed for at the tender stage.

Alternative Dispute Resolution

Mediation can be an inexpensive first step to resolve differences between both parties. It is a low cost alternative to the Court process. Many problems can occur when you are building or renovating even if you are the contractor. Some can be sorted out face to face, but others can escalate to a complaint or dispute. That's when you need professional help. Mediation is not a compromise. The idea with Mediation is to jointly examine issues which really matter and reach an agreement you can live with after listening to the other side's comments. To solve the problem without excessive cost, delay or stress. Essentially everything in a mediation is meant to be off the record. It's designed to get parties to speak openly. This means you can admit a mistake without anyone being able to use it against you later. Similarly, a contractor can't use any concession offered by the owner at the Mediation unless a resolution is reached.

If the Mediation is successful, the Mediator will prepare an agreement which both parties will sign. The Mediator will arrange rooms or often he or she might like to use two rooms in your building. Bush Fire Assessment Report

A Bush Fire Assessment Report provides a Bush fire Attack Level as well as an assessment of the development against the requirements of the Rural Fire Service document, Planning for Bush Fire Protection. It satisfies section 4.14 (s4.14) of the Environmental Planning and Assessment Act 1979 or section 100B of the Rural Fires Act 1997 and can be used for a development application to Council. It also satisfies clause 3.4 (2) (a) or clause 3A3.7 (2) (b) Development Standards for bush fire prone land under the State Environmental Planning Policy Code (2008) and can be used for a Complying Development application to a Principal Certifying Authority.
Your report will be structured to assist your local Council development assessment officer and the Rural Fire Service to assess your development. There are bush fire protection measures that can be incorporated into a proposed development to minimise the bush fire impact on life and property.

The six bush fire protection measures that are addressed in Planning for Bush Fire Protection 2006 include:

Bush Fire Compliance Certificate

A Bush fire Compliance Certificate is prepared at the end of construction to Certify that the development has been carried out in accordance with the requirements of the Bush fire Attack Level nominated by the BAL Certificate or Development Consent. It will also consider the requirements of Planning for Bush fire Protection. Your Certifier is entitled to rely on this Certificate in relation to bush fire matters when issuing the Final Occupation Certificate.

Bush Fire Attack Level (BAL) Certificate

A BAL certificate is a statement of the Level of Bush fire Attack for your land or development. It certifies that the development is not in the Flame Zone or BAL 40. A BAL Certificate is a legislative requirement if you are carrying out Complying Development on bush fire prone land. It must be prepared by a suitably qualified consultant in bush fire risk assessment.

Our BAL Certificate satisfies the State Environmental Planning Policy Code (2008) The General Housing Code Part 3, Division 2, Clause 3.4 (2) (a) the development will not be carried out on any part of the lot that is bush fire attack level-40 (BAL 40) or in the flame zone (BAL FZ), or the Rural Housing Code, Part 3A, Division 3 Subdivision 9, Clause 3A.37 (2) (b) the part of the lot on which the development is to be carried out and any associated access way is not in bush fire attack level-40 (BAL 40) or the flame zone (BAL FZ). There are other parts of this Code relating to bush fire which still have to be met, and therefore we recommend you purchase a Bush Fire Assessment Report. Bush Fire Attack Level (BAL) Assessment

If you are thinking of purchasing vacant land and would like a feasibility study to help identify development options, we can provide an assessment of the BAL. This report provides an assessment in relation to the future development location or the lot itself. A building envelope can be provided to show where best to locate the development where there is a choice of positions. Our advice is aimed at minimising the BAL as well as providing certainty prior to your purchase.

Bush Fire Assessment Report for Dual Occupancy or Subdivision

A Bush Fire Assessment Report for dual occupancy provides a Bush fire Hazard Assessment as well as an assessment of the development against the requirements of the Rural Fire Service document, Planning for Bush Fire Protection. In addition, Section 100B of the Rural Fires Act 1997 requires that a Bush Fire Safety Authority (BFSA) be issued by the Rural Fire Service for this type of development on bush fire prone land, and our report meets the submission requirements to enable this document to be issued.
